Services provided by Florida Songwriters Association, LLC (herein after referred to as FLSW), will be executed by industry professionals of FLSW or contracted by FLSW, herein after referred to as FLSW Representative(s) in this document.
These services include but are not limited to:
1) Annual Association Membership – further defined into 3 levels (Gold, Platinum, & Diamond) with specific services assigned to each level of membership. By becoming a member, FLSW does NOT guarantee, in any way, that its members will be successful as a songwriter or artist in the entertainment or any other industry. Membership lasts for a period of no less than one (1) year, at which point the member will have the option to renew for another year, upon agreement by FLSW. FLSW reserves the right to refuse membership, upon initial request or at the time of renewal, and this is solely at the discretion of FLSW Executives. Once membership is accepted (Parental Consent form (if applicable) and Payment received), the member will then be emailed a username and password to access the Members Only section of the site. In this section, a member will enjoy access to their account page, the Resources page, and any other Members Only pages created going forward. The specific services for each level of membership referenced above are as follows:
b. One-on-One Mentoring Sessions (via internet – e.g. Skype) – the mentoring sessions are solely provided to the Platinum and Diamond membership levels. The number of sessions included is specific to each level and is detailed under each membership level on the “Join Us” page of the web site. Each session will involve an FLSW Representative and the individual member. These sessions will last for a time frame of no greater than 25 minutes. Once the request for a mentoring session is received, an FLSW Representative will acknowledge the receipt of such request and soon thereafter, provide a date and time for when the session will be held. In order to participate in these sessions, the member must have an account with whichever internet program FLSW designates for these sessions. The member must provide their username for the designated program in their email request for a session. FLSW reserves the right to change, at any time, the internet-based program with which they will conduct these mentoring sessions. FLSW will notify members, via e-mail, of any such changes. During the session, the conversation should only involve topics related to the songwriter’s work, past or present, and should not deviate from these areas. Personal information about the FLSW Representative is off-limits and should not be requested by the member(s). Poor conduct by the member (profanity, derogatory comments, explicit behavior, illegal conduct, etc.) will not be tolerated by FLSW or its Representatives. If such poor conduct is exhibited, the FLSW Representative has the right to terminate said mentoring session and will document the specific nature of the poor conduct. If this occurs, the circumstances will be reviewed by FLSW Executives and actions will be taken in accordance with the Member Guidelines Policy.
2) Annual Music Conference – Depending on the level of membership, access will be offered at a discount for Gold (20%) and Platinum (50%) levels, while Diamond level is granted access at no cost. Entrance fees will be specified when the event is announced along with date(s) of commencement. Dates are determined in the year the conference will be held and could be different than the prior year(s). All members will be notified once the date(s) have been designated. Member conduct, while in attendance at these conferences, is subject to the terms described in the Member Guidelines Policy. Details of each conference will be described upon announcement of the conference.
3) Annual Songwriters Competition – Gold and Platinum level memberships will be required to pay a discounted fee (20% and 50%, respectively) for entry into the contest, while Diamond memberships will be granted free access. Non-members can submit entries but will have to pay a full-fare fee. Entrance fee and date of the competition will be specified upon announcement of the competition. The contest will consist of a submission period and a review period before the winner will be announced. The exact method of submission will be detailed when the dates of the contest are announced. Each submission MUST include an mp3 file with vocals and at least one instrument and a lyric sheet. Full production songs will be accepted, but this will not increase the chances for selection as the winner. Any additional criteria for submissions will be detailed upon announcement of the competition dates. Any submissions received that don’t meet the minimum criteria as stated in the competition rules, will automatically be disqualified and the member notified. Once notified, and provided there is still time left in the submission period, the member will have the opportunity to resubmit their song with the required criteria. NO SONGS WILL BE ACCEPTED AFTER THE SUBMISSION PERIOD HAS EXPIRED. There will only be one winner, and the prize will consist of, but will not be limited to, a cash award (in the form of a check), exposure on the FLSW site as the contest winner, and a publishing deal with Veal-Steen Music Publishing. The judges for the competition will be FLSW Representatives, with the final judgment coming from the executives of Veal-Steen Music Publishing.
4) Podcasts, Videos, Newsletters, Resources, and Other Events – FLSW plans to incorporate several other means of educating and motivating our members. As these plans come to fruition, FLSW will notify its members and release documents that govern the use and participation of these plans. The resources provided on the “Resources” page of the FLSW web site are only meant to be used as guides and are NOT official, legal documents. These resources will only be accessible by FLSW Representatives and members. FLSW provides such documentation in an effort to educate its members, but ultimately it is the members’ responsibility to do their own research when engaging in legal or monetary matters outside of FLSW. Each member agrees that he/she will release, waive, indemnify, and hold harmless FLSW, its employees, board of directors, officers, attorneys, agents, other members, and representatives from and against any and all claims, demands, losses, and liabilities of any nature, known or unknown, for any legal or financial transactions that involve the member (good or bad), except where those transactions involve FLSW membership or FLSW sponsored events and involve a direct transaction between the member and FLSW. FLSW strives to provide its members the most current and accurate information, but the changing industry and the rules that govern it, may result in some information being inaccurate. However, in the event that any of the information provided is inaccurate, FLSW welcomes its members input to bring this to the association’s attention. Once FLSW is notified of the alleged error, the information will be investigated and a determination will follow. FLSW will not be held legally responsible for any misinformation on the web site, and all members will be required to agree to such terms upon applying for membership.
FLORIDA SONGWRITERS ASSOCIATION, LLC RESERVES THE RIGHT TO MAKE AMENDMENTS TO THESE TERMS OF SERVICE AT ANY TIME THAT IT DEEMS NECESSARY. FLSW WILL ATTEMPT TO NOTIFY ITS MEMBERS OF ANY SUCH CHANGES IN A TIMELY MANNER, BUT IT IS ULTIMATELY THE RESPONSIBILITY OF EACH MEMBER TO ROUTINELY CHECK THESE TERMS OF SERVICE FOR ANY CHANGES. FLSW MAKES NO GUARANTEES OR PROMISES THAT IT WILL SUCCESSFULLY NOTIFY ANY MEMBER OF AMENDMENTS TO THIS DOCUMENT.
